Changes to the Qualifying Period for Permanent Residence and what this means for Hospitality The Home Secretary has announced on the 20.11.2025 a major consultation on proposals to extend the qualifying period for settlement from 5 years to 10 years under a new contribution-based model. Whilst not applicable to migrants who are dependants of British citizen, the new rules are set to apply to all other visa route, including but not limited to, Chefs and FOH staff sponsored on Skilled Workers visas.  If approved, the new rules will mean that all migrants will qualify for Permanent Residence after 10 years but could have this reduced to as early as 3 years or as long as 30 years, subject to various criteria. The new proposed “time adjustment” includes aspects such as the migrant’s immigration and criminal history, their contributions to the UK through charity work but most notably for Hospitality their economic contributions. The 10-year qualifying period can be reduced if migrants meet the following:   Earning more than £125,140 for at least 3 years - qualify after 3 years.  Earn more than £50,270 for at least 3 years - qualify after 5 years. The Home Office have not mentioned whether Tronc can be included in the above, but it does mean that Chefs or FOH staff who are high earners could obtain Permanent Residence within 3 years. Other discounts proposed for higher level of English language (at C1 level), nationals of majority English speaking countries would automatically qualify. The consultation survey will remain open until 12th February 2026 so we envisage that, if approved, the new rules could come into effect as early as April 2026.
