Indian restaurant fined £40,000 after incorrect labelling leads to severe allergic reaction

An Indian restaurant in Uxbridge has been fined more than £43,000 after a customer with a nut allergy suffered a severe allergic reaction due to undeclared allergens in their meal.

Javitri, located on High Street and operated by JR Uxbridge Ltd, pleaded guilty to five offences under health and food safety laws at Uxbridge Magistrates’ Court on April 22.

The company was fined £35,000, ordered to pay a £5,000 victim surcharge, and £3,816 in council prosecution costs.

The investigation, led by Hillingdon Council’s food hygiene officers, followed a complaint from a hospitalised customer in June 2024.

Officers discovered multiple food safety breaches, including incorrectly stored nuts, incomplete menu descriptions, and staff unable to confirm ingredients, despite having undergone allergen training weeks earlier.

Despite being issued a detailed report and improvement notice, the restaurant failed to meet requirements.

A follow-up visit revealed the allergen menu remained confusing and inaccurate, and revised documents submitted to the council were still inadequate.

Cllr Eddie Lavery, cabinet member for Community and Environment, said: “Providing accurate allergen information is a legal responsibility. This case highlights the serious consequences of getting it wrong.”

He added that the council’s food safety team will continue taking action against businesses that neglect public safety.
